Bristol West Insurance to pay $5m to settle suit against insurers over claims
Bristol West insurance, the insurer for the Rock and Roll Hall of Fame, will pay $2.5 million to settle claims brought by the Rock’s former health care and personal injury attorneys.
The Rock, who died of cancer in 2012, and his former law firm filed a $4.2 million claim against Bristol West in March 2017.
The lawsuit alleged that Bristol West knowingly misled customers by misleading them about its coverage and that Bristol failed to comply with an internal review of its medical claims program and its claim payment programs.
The suit was filed on behalf of Rock stars and members of the Rock Band, which was one of the original Rock bands.
The claims were settled by a jury in February, and the verdict was announced Thursday in Bristol West’s first court appearance in years.
In its motion to dismiss the claim, Bristol West asserted that it has been unable to meet its obligations under the law and that it “fails to fulfill its obligations as a fiduciary under state and federal laws.”
Bristol West also alleged that the Rock is seeking damages for “loss of business profits, pain and suffering, medical expenses and other damages.”
Rock stars who sued the insurer said that they were left out of the payments.
“I feel like a fraud,” said drummer Matt Skiba, who sued Bristol West, saying that he lost his job, his health insurance and his home.
Skiba added that he had been a Rock Band member for 30 years, and was unaware of the insurance policy.
“It’s just the worst thing you can do,” Skiba said.
“They’re taking care of the band, they’re paying for all of our expenses.
They’re not putting us in a position where we’re going to go bankrupt.”
The Rock and his attorneys have denied any wrongdoing.
The band members also said that the insurer did not disclose the Rock band members’ health issues or discuss their coverage with the band members.
The insurance claim was filed in the state’s Northern District Court in Bristol, a city in the south of England.
Bristol West was founded in 2013, and its headquarters are in Newport, Rhode Island.
Rock band member Nick Cave said in a statement that the company is disappointed by the verdict, but “we are confident that Bristol will prevail.”
“We are grateful to all of those who have worked so hard to make Bristol West a great company,” the statement read.
The statement said that Bristol’s decision to settle was in line with a number of other insurance and health care settlement agreements.
“These agreements reflect the best of our industry, the best intentions of both parties, and their desire to work together in a manner that protects our clients’ interests,” the company said in the statement.
